Wombat’s Den Terms, Conditions and Privacy Policy

These Terms, Conditions and Privacy Policy apply to accommodation and other services booked directly with Wombat’s Den, including through our website, telephone, email or direct booking system.

When you make a booking, you confirm that you have read, understood and accepted these terms on behalf of yourself and every person included in the booking.

Where a booking is made through a third-party booking platform, the platform’s payment and cancellation procedures may also apply. These terms continue to apply to your use of and conduct at the property.

1. About Wombat’s Den

In these terms, “Wombat’s Den”, “we”, “us” and “our” refer to Wombat’s Den Pty Ltd, ABN 45 695 491 500.

Wombat’s Den™ is a Trademark of Wombat’s Den Pty Ltd.

Wombat’s Den provides short-stay accommodation in Gembrook, Victoria.

2. Bookings

A booking is not confirmed until:

  • the required payment has been received or successfully authorised;
  • Wombat’s Den has issued written booking confirmation; and
  • the person making the booking has accepted these terms.

The person making the booking must be at least 18 years old and is responsible for:

  • ensuring all booking information is accurate;
  • making all payments associated with the booking;
  • communicating these terms to the other guests; and
  • the conduct of every person included in or invited onto the property under the booking.

Bookings may not be transferred, resold or assigned to another person without our prior written approval.

The cabin may only be occupied by the number of guests stated in the booking confirmation and must not exceed its advertised maximum occupancy.

3. Rates and inclusions

All prices are quoted in Australian dollars and include GST where applicable.

The rate includes only the accommodation, facilities and inclusions identified in the booking confirmation. Optional extras, packages, activities and third-party services may be subject to separate conditions.

Any promotion, package or special offer may have additional terms. Where those terms conflict with this policy, the specific written terms of the promotion or package will apply to the extent of the inconsistency.

4. Payment

Payment must be made in accordance with the Payment Policy and the due dates shown on the booking confirmation or invoice.

Wombat’s Den may cancel an unpaid booking where payment has not been received by the due date, after making reasonable efforts to contact the guest.

Guests are responsible for any bank, card-provider, currency-conversion or international transaction fees charged by their financial institution.

5. Changes and cancellations

Guest cancellations and booking changes are governed by the Cancellation Policy current at the time the booking is made.

Requests to change a booking are subject to availability and are not confirmed until accepted by Wombat’s Den in writing. A change of dates may result in a different accommodation rate.

Reducing the number of guests, shortening the stay, changing cabins or moving the booking may be treated as a partial or complete cancellation.

6. Arrival and departure

Check-in and check-out times will be provided in the booking confirmation or pre-arrival information.

Early check-in and late check-out are subject to availability and must be approved in advance. Additional charges may apply.

Guests must follow the arrival, parking, access and departure instructions provided by Wombat’s Den.

Where requested for security or fraud-prevention purposes, the person who made the booking must provide valid photographic identification matching the booking details.

7. Property use and guest conduct

The cabins and property must be used only for private short-stay accommodation unless another use has been approved in writing.

Parties, functions, events, commercial photography, gatherings and additional visitors are not permitted without prior written approval.

Guests must not:

  • create excessive noise or disturb other guests, neighbours, wildlife or livestock;
  • engage in unlawful, dangerous, threatening, abusive or discriminatory conduct;
  • interfere with safety, security, fire-protection, electrical, water, wastewater or communications equipment;
  • use the property for commercial or illegal purposes;
  • bring additional occupants onto the property contrary to the booking;
  • damage, remove or misuse property belonging to Wombat’s Den; or
  • enter areas identified as private, restricted, closed or unsafe.

Guests must comply with reasonable directions given by Wombat’s Den concerning safety, property protection and guest conduct.

Wombat’s Den may require a guest or visitor to leave where there is a serious or repeated breach of these terms, unlawful conduct or an immediate risk to people, property, wildlife or the environment. Where a stay is terminated because of a guest’s breach, refunds will not ordinarily be provided for unused accommodation, subject to the Australian Consumer Law.

8. Smoking, vaping, flames and fire safety

Smoking and vaping are prohibited inside all cabins and enclosed structures. Smoking is prohibited on the property.

Candles, incense, fireworks, fire pits, portable barbecues and other open flames or ignition sources must not be used unless expressly supplied or approved by Wombat’s Den.

Guests must comply with all fire restrictions, Total Fire Bans, emergency warnings and instructions issued by Wombat’s Den, the Country Fire Authority, Victoria Police, Emergency Management Victoria or another relevant authority.

Fireplaces and any other supplied heating or cooking equipment must only be used in accordance with the instructions provided.

Guests may be charged reasonable cleaning, repair or emergency-response costs resulting from unauthorised smoking, fire use or interference with fire-safety equipment.

9. Bushfire risk, severe weather and emergencies

Wombat’s Den is located in a bushfire-prone area. Weather conditions and fire risk may change quickly.

Guests are responsible for checking weather forecasts, Fire Danger Ratings, emergency warnings and road conditions before and during their stay.

Catastrophic Fire Danger Rating

Wombat’s Den will close to guests whenever a Catastrophic Fire Danger Rating applies to the relevant fire weather district for any part of a booked stay.

No guests will be permitted to check in or remain at the property during the affected closure period. Guests may be required to leave the property the preceding evening or at another time specified by Wombat’s Den so that they can depart safely before conditions deteriorate.

For accommodation cancelled by Wombat’s Den because of a Catastrophic Fire Danger Rating, guests may choose between:

  • transferring the value paid for the affected accommodation to another available date; or
  • receiving a refund of the amount paid to Wombat’s Den for the affected accommodation.

No cancellation administration fee will apply to accommodation cancelled by Wombat’s Den under this provision.

Other emergency closures

Wombat’s Den may also close or evacuate the property where accommodation cannot reasonably or safely be provided because of:

  • an active fire, flood, storm or other natural disaster;
  • an emergency warning, evacuation direction or road closure;
  • unsafe access to or from the property;
  • loss of an essential service that makes the accommodation unsafe or materially uninhabitable; or
  • a direction or recommendation from an emergency service or government authority.

Where Wombat’s Den cancels accommodation for one of these reasons, guests will be offered a transfer, credit or refund for the accommodation that cannot be provided, subject to the Australian Consumer Law.

Where the property remains open and accessible but a guest chooses not to travel because of personal concerns, forecast weather, smoke, transport disruption or changed circumstances, the standard Cancellation Policy will ordinarily apply. Wombat’s Den may offer a date change or other assistance at its discretion.

Guests should obtain suitable travel insurance covering cancellation, illness, transport disruption, severe weather and natural disasters.

10. Natural environment and property conditions

Wombat’s Den is a rural bush property. Guests may encounter uneven ground, steps, fallen branches, slippery surfaces, mud, water bodies, wildlife, insects, snakes, changing weather and limited lighting.

Guests must:

  • take reasonable care when walking around the property;
  • wear footwear and clothing appropriate to the conditions;
  • supervise their own activities;
  • remain on designated paths where directed;
  • observe signs, barriers and closure notices; and
  • avoid approaching, feeding or interfering with wildlife.

Access to trails, water bodies and outdoor areas may be restricted or closed because of weather, fire risk, maintenance or safety concerns. Closure of a non-essential outdoor area does not automatically entitle a guest to cancel the entire booking or receive a refund unless the accommodation or a material part of the contracted service cannot be provided.

11. Water, utilities and connectivity

The property uses rural infrastructure, which may include tank water, septic systems and internet services affected by terrain, weather, power interruptions and third-party networks.

Guests must use water responsibly and must not flush or dispose of unsuitable products through sinks, toilets or drains.

Wi-Fi, mobile reception and streaming services are provided where available but continuous or uninterrupted service cannot be guaranteed. Temporary interruption to a non-essential service will not ordinarily entitle a guest to a refund, unless required under the Australian Consumer Law.

12. Allergies and accessibility

Guests must advise Wombat’s Den before arrival of any relevant allergies, sensitivities or accessibility requirements.

While reasonable efforts will be made to assist, Wombat’s Den cannot guarantee an allergen-free environment.

Guests should contact us before booking where access, mobility, medical equipment or another requirement may affect their ability to safely use the accommodation.

13. Damage, additional cleaning and charges

Guests are responsible for loss or damage caused by themselves, members of their booking or invited visitors, excluding fair wear and tear.

Wombat’s Den may charge the reasonable cost of:

  • repairing or replacing damaged or missing property;
  • excessive or specialist cleaning;
  • smoke, odour or contamination remediation;
  • call-outs caused by guest actions;
  • restoring furniture or equipment moved without permission;
  • disposing of excessive rubbish; or
  • addressing breaches of occupancy, smoking or fire-safety rules.

We will provide reasonable details of any charge and, where practicable, supporting photographs, invoices or estimates.

Charges will reflect the reasonable loss or cost incurred and will not be imposed as a penalty.

14. Personal belongings and lost property

Guests are responsible for securing their vehicles, valuables and personal belongings.

Nothing in these terms excludes liability that cannot legally be excluded. However, to the extent permitted by law, Wombat’s Den is not responsible for loss, theft or damage to personal belongings where the loss was not caused by our failure to exercise due care and skill.

Lost property will be held for a reasonable period. Guests are responsible for collection or the cost of postage and handling. Perishable, hazardous or low-value items may be disposed of sooner where appropriate.

15. Photography and surveillance

Guests may take photographs for personal, non-commercial use, provided this does not disturb other guests or involve access to restricted areas. The use of drones require prior written permission.

Commercial photography, filming, advertising, events or content-production activities require prior written permission.

Security cameras may operate in outdoor common, access, driveway or operational areas for safety, security and property protection. Cameras will not be installed inside guest cabins or other areas where guests would reasonably expect privacy.

16. Third-party services and experiences

Some experiences, packages or services may be delivered by independent third-party providers.

Those services may be subject to the provider’s own terms, eligibility requirements, waivers and cancellation policies. Wombat’s Den is not responsible for the acts or omissions of an independent provider except to the extent required by law.

Where Wombat’s Den collects payment as an agent for a third-party provider, any non-recoverable third-party cancellation costs will be clearly identified where reasonably practicable.

17. Australian Consumer Law

Our services come with guarantees that cannot be excluded under the Australian Consumer Law.

Nothing in these terms excludes, restricts or modifies any consumer guarantee, right, remedy or liability that cannot lawfully be excluded, restricted or modified.

Where permitted by law, Wombat’s Den’s liability will be limited to the remedies available under the Australian Consumer Law and to loss that was reasonably foreseeable and directly connected with the relevant failure.

18. Events beyond reasonable control

Neither party will be responsible for failing to perform an obligation where performance is prevented by an event beyond that party’s reasonable control.

This may include natural disasters, bushfires, floods, storms, road closures, government directions, public-health emergencies, utility failures, industrial action or other serious disruptions.

This clause does not remove any right or remedy available under the Australian Consumer Law. Where Wombat’s Den cannot provide booked accommodation, the emergency and cancellation provisions in these terms will apply.

19. Complaints and disputes

Guests should raise concerns as soon as possible during their stay so that Wombat’s Den has a reasonable opportunity to investigate and address them.

We will endeavour to acknowledge the complaint promptly and work with the guest in good faith toward a fair resolution.

These terms are governed by the laws of Victoria, Australia. The parties submit to the jurisdiction of the courts and tribunals of Victoria, subject to any legal right to bring proceedings elsewhere.

Privacy Policy

20. Information we collect

Wombat’s Den may collect personal information including:

  • names and contact details;
  • booking dates and guest numbers;
  • billing and transaction information;
  • communications, requests and feedback;
  • identification details where reasonably required;
  • accessibility, dietary or allergy information voluntarily provided by a guest;
  • technical information associated with website use;
  • security-camera footage from outdoor operational areas; and
  • information supplied through booking platforms, payment processors or service providers.

We do not ordinarily retain complete payment-card details. Card payments may be processed and stored securely by our booking-system or payment-processing providers.

21. Why we collect information

We may collect, use and disclose personal information to:

  • process and manage bookings and payments;
  • communicate booking, arrival, safety and emergency information;
  • provide accommodation, experiences and requested services;
  • respond to enquiries, complaints and special requirements;
  • prevent fraud and protect guests, staff and property;
  • maintain business, accounting and legal records;
  • improve our services and website;
  • send marketing communications where consent has been given or where otherwise permitted by law; and
  • comply with legal, regulatory, insurance and emergency-management obligations.

Guests may unsubscribe from marketing communications at any time. Transactional, safety and booking-related communications may still be sent where necessary.

22. Disclosure of information

We may disclose relevant personal information to:

  • booking-system, payment and website providers;
  • accountants, insurers, professional advisers and technology providers;
  • contractors and experience providers involved in delivering a booking;
  • emergency services or government authorities where reasonably necessary;
  • third-party booking platforms through which the booking was made; and
  • another party where required or authorised by law.

Some service providers may store or process information outside Australia. Where reasonably practicable, we will use reputable providers and take reasonable steps to protect the information disclosed.

We do not sell guests’ personal information.

23. Storage and security

Wombat’s Den takes reasonable steps to protect personal information from misuse, interference, loss and unauthorised access, modification or disclosure.

Information may be held electronically or in paper records. Records are retained only for as long as reasonably necessary for the purpose for which they were collected, including legal, tax, insurance and dispute-resolution requirements.

No internet transmission or electronic storage system is completely secure. Guests should avoid sending sensitive information through unsecured channels unless necessary.

24. Website cookies and analytics

Our website and booking providers may use cookies, analytics tools and similar technologies to:

  • operate the website and booking process;
  • remember preferences;
  • understand website traffic and performance;
  • prevent fraud; and
  • improve advertising and marketing.

Guests can control some cookies through their browser settings, although disabling cookies may affect website or booking functionality.

25. Access and correction

Guests may contact Wombat’s Den to request access to personal information held about them or to ask that inaccurate information be corrected.

We may need to verify the requester’s identity. Access may be limited where permitted or required by law.

27. Changes to these terms

Wombat’s Den may update these terms from time to time.

The terms applying to an existing booking will generally be those accepted when the booking was confirmed, except where a change is required by law, relates to urgent safety matters or is expressly agreed with the guest.

The current version will be published on our website with its effective date.
